Mixed fortunes for couple in protracted battle with metro

THE protracted legal wrangle between businessman Phillip Georgiou and his wife, Yvette, against the Nelson Mandela Bay Municipality is set to continue – with both notching up a win in their latest courtroom battles.

The Georgious, who own the popular boutique hotel, spa and wedding venue in Kragga Kamma Road, won the right to appeal against an order by Judge Mandela Makaula in the Grahamstown High Court. But they were dealt a blow last week when Judge Glenn Goosen dismissed another application for leave to appeal.

Georgiou said his legal team had already taken Goosen’s decision to the Supreme Court of Appeal in Bloemfontein.

“We intend to fight this until we win, even if it means going to the Constitutional Court,” he said.

“This case is going to make case law where business people working from home are concerned. Their rights to run a business from home will be upheld.”

Georgiou said Makaula’s decision to grant leave to appeal proved they had reasonable prospects of success.
