Guest house court battle may end
TO avoid a lengthy legal battle for failing to act against other Summerstrand homeowners in contravention of a restrictive 1934 land act, the Nelson Mandela Bay Municipality is considering an out-of-court settlement with Access Guest House owners Pungee and Persotam Naidoo.
The Naidoos, who had to demolish parts of their home last year, have hauled the metro to court for approving the plans to renovate their home.
They believe the municipality should not have approved the plans because they knew there were title deed restrictions in place that governed Summerstrand Extension 1 and superseded newer municipal zoning schemes. - Rochelle de Kock
