Nurse granted leave to appeal nap sacking

THE Port Elizabeth High Court has granted leave to appeal to a nurse who launched a lengthy court battle after she was fired for taking a nap while on her lunch break and then tried to have a "fraudulent" settlement agreement set aside.

Last year, the late Judge Duncan Dukada dismissed Diane Lawrie's application to have a settlement agreement drawn up by the Commission for Conciliation, Mediation and Arbitration (CCMA) and her former employers be declared null and void.

But a determined Lawrie applied for leave to appeal against Dukada's decision which was granted this week by Judge Dayalin Chetty.

In his judgment, Chetty said he was of the view leave should be granted, despite Life Healthcare's advocate indicating he had instructions to oppose the application. - Lee-Anne Butler
