Samwu man to fight high court ruling

A SA Municipal Workers' Union (Samwu) provident fund member who was in June interdicted from bad-mouthing the fund will fight back.

Nelson Mandela Bay municipal worker Ayanda Mtyhopo is seeking leave to appeal the Grahamstown High Court's decision to interdict him from in any way disparaging the fund.

The Legal Resources Centre, which is representing him, says the judgment will have a serious effect on freedom of speech.

"The approach of the learned judge unduly restricts the right to freedom of expression and will have a serious chilling effect on the legitimate expression of speech in the future," the LRC said in its application for leave to appeal. - Adrienne Carlisle
