Prosecutor in court on corruption charge


A state prosecutor charged with fraud and corruption after he allegedly requested bribes to quash cases appeared in court on Friday.
Thozama Theophilus Takane, 45, was arrested on April 23 at the Uitenhage Magistrate’s Court.
This followed swift action by the Serious Corruption Investigation Unit of the Hawks.
It is alleged Takane demanded a R1,500 bribe from Luvuyo Bokwe, 46, who was an accused in an assault case.
In court papers, Takane was the prosecutor in the case against Bokwe and Nxaxho Mzezeleli Crosby, who were both accused of assault with intent to do grievous bodily harm.
It is alleged that Takane offered to scrap the case if he was paid R1,500.
Bokwe and Mzezeleli agreed to make the payment and Takane withdrew the charges.
The two then reported the matter to the police and Takane was arrested shortly after the payment was made.
Takane is further charged with fraud after he promised a mother of an alleged minor that if she gave him R500 he would use it to pay a fine imposed on her son if he was found guilty of theft.
The state claims Takane misappropriated the R500 and at no stage could he guarantee that the court would impose a fine.
Takane was released on R5,000 bail on April 26.
Part of his bail conditions are that he is not allowed to set foot in the Uitenhage and Kwanobuhle courts.
On Friday, Takane’s case was postponed to October 22 for the state to provide the defence with a digital copy of the docket along with other information related to the case.
