Man wins R100000 damages for unlawful arrest

A PORT Elizabeth man charged with the 2009 rape of a woman outside Legacy Sports Bar has successfully sued the minister of police for wrongful and unlawful arrest.

The minister has been ordered to pay Leon Chamberlain R100000 in damages after Judge Jannie Eksteen ruled there was no evidence to conclude Chamberlain was the perpetrator.

Chamberlain was accused of raping the woman in his Mazda, which was parked outside the Lorraine bar on the evening of June 20 2009.

He was arrested at the Walmer police station on June 26 2009, and detained until the following Monday morning, when he appeared in the Port Elizabeth Magistrate's Court and the charge against him was provisionally withdrawn. - Kathryn Kimberley
