Man suing municipality for fall

A PORT Elizabeth man who tripped over exposed stormwater drain rods last month is suing the Nelson Mandela Bay Municipality.

Although the drain was fixed a week after Lauwrens Scheepers, 43, fell, he is going ahead with his lawsuit after he injured his back and neck in the fall.

Scheepers's lawyer, Masunet Strydom, said they believed they had a strong case.

"My client [Scheepers] is suing for ... pain and suffering, as well as the medical costs incurred, which amount to just over R1000. I am confident of our case because of the circumstances," Strydom said.

"There was no warning sign alerting the public to the hazard, the lighting was very bad ... [Also] even after reporting [the problem] to the municipality, they still took over a week to rectify [it]."
