The man who thought he was the father of baby Siwaphiwe will post bail for her mother‚ even though her secret affair has been thrust into the spotlight.

The Durban Magistrate’s Court on Wednesday heard that the mother and her lover would face charges of fraud and defeating the ends of justice. An earlier charge of kidnapping was withdrawn.

Her lawyer‚ Mfanafuthi Biyela‚ said her husband would post her R1 000 bail.

The married couple walked out of court together soon after he posted bail. In his hand was a plastic bag with his wife’s belongings.

The mother still had a scarf covering her face from chasing photographers. Her husband and relatives whisked her away in a Toyota Corolla.

Outside court 10‚ where the matter was heard‚ neither Biyela nor the husband would comment on the paternity of one-month-old Siwaphiwe.

Before walking away‚ an angry the husband said‚ “I have nothing to say. This is my family we’re talking about.”

The boyfriend’s family‚ who were also approached outside court following the decision‚ said: “We are not talking.”

The boyfriend himself was nowhere to be seen.

NPA spokesman Natasha Ramkissoon-Kara said that it was not in the State’s interests to pursue the kidnapping charge.

She refused to answer whether or not this decision had to do with the hotly contested paternity issue‚ with the boyfriend claiming to be the father and his lawyer asking for a paternity test.

The court ruled that the Family Court would handle the paternity issue.
