THE Public Health and Social Development Sectoral Bargaining Council has ruled in favour of Eastern Cape Health MEC Sicelo Gqobana in a case between the department and former senior manager Clayton Bhana.
Bhana reported the MEC to the bargaining council claiming constructive dismissal. Former health superintendent-general Dr Siva Pillay testified against his former boss in the case.
According to documents seen by Times Media, Bhana, a former health department Emergency Medical Services (EMS) senior manager, laid a complaint of constructive dismissal against Gqobana in April 2012.
This emanated from being overlooked for a general manager's position within health in 2011.
