Man's case against Pick n Pay Cleary Park dismissed

THE Port Elizabeth High Court yesterday dismissed an application by a man who dragged Cleary Park's Pick n Pay store to court for damages arising from a breach of contract because it was concluded with an assistant store manager who did not have the authority to do so.

Warren Cherry, 35, of Cleary Estate, said he had been approached by the assistant store manager and asked if he was in a position to perform a contract on behalf of Pick n Pay.

The assistant store manager, Johan Plaatjies, has since been dismissed as a result of organising these contracts following a disciplinary process.

Cherry, who is self-employed, said the contract would have entailed transport services for staff members employed at the store. He said he had bought a vehicle, at a cost of R180000, in order to render this service. - Lee-Anne Butler
