Eight-year-old rape victim unable to understand court proceedings

AN eight-year-old girl who was subjected to a 15-hour rape ordeal two years ago, does not have the intellectual capacity to testify and understand the court proceedings, the Port Elizabeth High Court heard yesterday.

This was the finding of clinical psychologist Karen Andrews who evaluated the little girl following her traumatic December 16 2011 experience at a house in Motherwell.

The brutal attack happened when the girl was only six years old.

Xolile Tose, 33, of KwaNoxolo, is accused of rape. It is alleged Tose lured the girl away from her friends while they were playing in the street. - Hendrick Mphande
