PORT Elizabeth attorney Joanne Anthony has advised that if you are planning on taking that walk down the aisle a second time – make sure you have your official divorce papers.
Even though many second-time around weddings often are smaller affairs than first, there are still legal requirements for a valid marriage.
According to Anthony one of the most common mistakes people can make when getting married again is not finalising their divorce. “You are not allowed in law to be married to more than one person,” she said. Doing so “makes the second marriage invalid”, or bigamous.
“Previously married partners need to check their status and have their divorce papers available and confirm that they are in fact divorced.
“Some people are ignorant and do not even get divorced and just marry someone else!”
